Glossary

Litigation
A legal proceeding in a court to determine and enforce legal rights. Litigation begins with the filing of a Complaint by a Plaintiff, followed by an Answer by the Defendant.

Plaintiff
The party that institutes a suit in a court.

Defendant
The party against whom an action is brought.

Complaint
The legal document filed by the plaintiff in a civil action, setting forth the facts and legal theory under which recovery is sought.

Answer
A legal document filed by the defendant in a civil action, setting forth facts and legal defenses to the Complaint.

Wrongful Death
A death that is caused by the wrongful act or negligence of another. Any civil action for damages is filed on behalf of the decedent's heirs, typically close family members.

Personal Injury Protection Benefits (PIP Insurance)
Automobile insurance that covers the medical expenses of the injured person without regard for who is at fault for causing the accident. PIP coverage usually has a set monetary limit and a set limit on the duration of treatment. For example: Coverage up to $10,000 and/or coverage for up to 1 year of treatment.
